TERMS AND CONDITIONS OF THE LAWALEATHER.COM ONLINE STORE

§1. General provisions

  1. These Terms and Conditions define the rules for the operation of and purchases made in the online store operated at the address lawaleather.com (hereinafter: the “Store”).

  2. By using the Store and accepting these Terms and Conditions, the Customer declares that they have read their content, understand their provisions, and undertake to comply with them.

  3. These Terms and Conditions constitute an integral part of the sales agreement concluded between the Customer and the Seller, and their acceptance is a necessary condition for placing an Order and concluding a sales contract.

 

 

§2. Seller and definitions

  1. The Seller and owner of the Store is:

    (hereinafter: the “Seller”).

  2. The Seller conducts mail-order sales of clothing available in the Store’s offer (hereinafter: “Goods”).

  3. Customer – a natural person, including a natural person conducting sole proprietorship, making purchases via the Store, declaring that they are of legal age and have full legal capacity necessary to conclude a distance sales agreement.

  4. Electronic service – a service provided electronically by the Store.

  5. Order – a declaration of intent by the Customer submitted via the form available in the Store, directly aimed at concluding a sales contract.

  6. These Terms and Conditions define the rules for purchasing Goods and placing Orders, the rules for fulfilling (delivering) Orders, the related costs, the rules for returns, as well as the rights and obligations of the parties to the sales contract, including in the event of non-conformity of the Goods with the contract.

 

 

§3. Placing and fulfillment of orders

  1. The Customer may place Orders for Goods available in the Store 24 hours a day, 7 days a week, 365 days a year.

  2. The Store conducts retail sales only. Wholesale sales and sales for further resale of Goods are not conducted.

  3. In order to place an Order, the Customer should:

  • add selected Goods to the cart,

  • complete the Order form by providing recipient details and delivery address, select a delivery method, and, if necessary, provide invoicing data,

  • accept the Terms and Conditions and the Privacy Policy,

  • click the button finalizing the purchase (e.g. “Pay now”),

  • choose a payment method and make payment in accordance with the selected option.

  1. Clicking the purchase finalization button constitutes placing a binding Order and obliges the Customer to make payment.

  2. Orders are fulfilled within the territory of the European Union.

  3. If the Customer has a discount code, they may enter it in the appropriate field. After confirmation, the Order price will be adjusted accordingly.

  4. A sales contract is concluded at the moment the Store confirms acceptance of the Order for processing.

  5. The Customer is obliged to pay the full price for the ordered Goods. An Order not paid within 24 hours may be cancelled, and the Store shall be released from the obligation to fulfill it.

  6. A condition for Order fulfillment is providing data enabling identification of the Customer, in particular an e-mail address. In the event of incomplete or incorrect data, the Store has the right to suspend Order processing until the data is completed.

  7. The Store reserves the right to additionally verify Customer data (e.g. via e-mail or telephone contact).

  8. The Customer receives information regarding the course of Order fulfillment (including status) at the provided e-mail address. The Store may also send information about an unfinished Order and – after fulfillment – an invitation to leave a review. Leaving a review is voluntary.

   §4. Prices and availability of goods

  1. Prices are given in Polish zloty (PLN) and are gross prices (including VAT).

  2. The stated prices do not include delivery costs. The total cost of the Order (price of the Goods + delivery cost) is shown in the cart before the Order is placed.

  3. Goods presented in the Store are generally available.

  4. In exceptional situations (e.g. simultaneous Orders for the same Goods), a Product may become temporarily unavailable. In such a case, the Customer will be informed without delay, no later than within 7 days from placing the Order.

  5. Some Goods may be available “made to order”. In such a case, the Customer may indicate the preferred color and size.

  6. Goods made to individual order are fulfilled within up to 30 days (including production and delivery time).

  7. Information about “made to order” availability and the estimated fulfillment time is provided in the description of each Product.

 

 

§5. Payment methods

  1. Payment for an Order may be made in the manner indicated on the Store’s website.

  2. The Customer may pay for the Order via an external payment system, in particular by online transfer, BLIK, or payment card.

  3. After proceeding to payment, the Customer is securely redirected to the website of the selected payment operator.

  4. If payment is not recorded within 1 hour from placing the Order, the Order may be automatically cancelled.

  5. The Store may use external payment operators (e.g. Przelewy24, PayU, Stripe, or others available in the Store). The Customer declares that before making payment they have read the operator’s terms and conditions.

  6. Commissions charged by payment operators are covered by the Store. This does not apply to any fees charged by the Customer’s bank.

  7. Payment confirmation and Order details are sent to the Customer’s e-mail address.

  8. Order fulfillment begins immediately after the payment is credited.

  9. The sold Goods remain the property of the Seller until the Customer has paid the full price.

 

 

§6. Delivery of goods

  1. Delivery is carried out within the territory of the Republic of Poland and to countries of the European Union. The Store does not offer cash-on-delivery shipments.

  2. The Store reserves the right to limit deliveries outside Poland.

  3. Delivery is carried out via:

  • InPost (parcel lockers),

  • courier companies.

  1. Delivery costs within the Republic of Poland are covered by the Seller. Delivery costs within the European Union are borne by the Customer.

  2. The delivery cost is indicated to the Customer before placing the Order and depends on the place of delivery, the Order value, and the selected delivery method.

  3. Changing delivery conditions after dispatch (e.g. address or date) may involve additional costs borne by the Customer, if resulting from the carrier’s decision.

  4. Upon receipt of the Goods, the Customer should check the condition of the shipment and the conformity of its contents with the Order. In case of damage, it is recommended to prepare a damage report in the presence of the courier.

  5. If the Goods are not delivered due to the Customer’s absence at the indicated address, the Order may be cancelled and the paid amount refunded, subject to deduction of costs incurred by the Store in connection with delivery.

  6. If delivery proves impossible for reasons beyond the Store’s control (e.g. lack of access), the Order may be cancelled and the paid amount refunded. The Store may propose another delivery date.

 

 

§7. Right of withdrawal from the contract (returns)

  1. A Consumer and an Entrepreneur with Consumer Rights have the right to withdraw from the contract within 14 days from the date of receiving the shipment, without giving any reason.

  2. To meet the deadline, it is sufficient to send a statement of withdrawal by e-mail to: kontakt.lawaleather@gmail.com.

  3. It is recommended to use the return form available in the “Returns” section on the Store’s website.

  4. The Goods should be returned within 14 days to the following address:
    LawaLeather Yuliia Osadchuk, Baildona 8/11, 40-115 Katowice, Poland.

  5. It is recommended to enclose the return form and proof of purchase (receipt/invoice).

  6. Returned Goods must be new, unworn, in unchanged condition, with original tags and security elements, without any signs of use, odors, stains, or damage.

  7. The Seller may refuse to accept the return or reduce the refund amount if the Goods have been used beyond what is necessary to check their nature and features (comparable to trying on in a brick-and-mortar store).

  8. The refund will be made no later than 14 days from the date of receipt of the returned Goods.

  9. The refund is made to the bank account indicated by the Customer.

  10. The refunded amount will be reduced by the cost of the original delivery of the Goods to the Customer.

  11. The cost and risk of returning the Goods are borne by the Customer.

 

 

§8. Complaints – non-conformity of goods with the contract

  1. The Seller is liable to the Customer for non-conformity of the Goods with the contract in accordance with applicable law (in particular, the Act on Consumer Rights).

  2. A complaint may be submitted by e-mail to: kontakt.lawaleather@gmail.com.

  3. It is recommended that the complaint include: a description of the defect, the date of its occurrence, the requested remedy (repair/replacement/price reduction/withdrawal from the contract), and contact details.

  4. Goods subject to complaint should be sent to:
    LawaLeather Yuliia Osadchuk, Baildona 8/11, 40-115 Katowice, Poland.

  5. Complaints are considered without delay, no later than within 14 days from receipt of the notification (for a Consumer / Entrepreneur with Consumer Rights).

  6. Failure to respond within 14 days means that the complaint is deemed justified.

  7. If the complaint is accepted, the Seller will first repair or replace the Goods, unless this is impossible or would require excessive costs.

  8. In the case of a Consumer, the cost of delivering defective Goods to the Seller is borne by the Seller. In the case of a Customer who is not a Consumer, such costs are borne by the Customer.

 

 

§9. Personal data

  1. The administrator of personal data is LawaLeather Yuliia Osadchuk.

  2. Personal data are processed in accordance with the GDPR and the Privacy Policy available in the Store.

  3. Data are processed in order to fulfill Orders, comply with legal obligations, and possibly pursue or defend claims.

  4. The Customer has rights under the GDPR, including the right to access data, rectify them, delete them, restrict processing, transfer data, and object to processing.

  5. The Customer has the right to lodge a complaint with a supervisory authority if they believe that data processing violates the law.

 

 

§10. Final provisions

  1. Photos of the Goods are for illustrative purposes only, and the color may differ depending on screen settings.

  2. All content, photos, descriptions, and materials in the Store are the property of the Seller. Copying and using them without the Seller’s consent is prohibited.

  3. The Store reserves the right to amend the Regulations in justified cases (including changes in law, Store functionality, Seller’s data, prevention of abuse, force majeure). Amendments take effect from the date of publication on lawaleather.com.

  4. Polish law applies to contracts concluded via the Store.

  5. Disputes with Customers who are not Consumers or Entrepreneurs with Consumer Rights shall be resolved by the court having jurisdiction over the Seller’s registered office.

  6. The Store uses cookies in accordance with the Privacy Policy.

  7. These Regulations are addressed to Consumers, Entrepreneurs, and Entrepreneurs with Consumer Rights, unless a given provision states otherwise.
